Terms of Service

Formsout grants you a limited, non-exclusive, non-transferable licence to use the Service for lawful personal or commercial purposes, subject to these Terms. You agree not to:

• Use the Service to collect, store, or process data unlawfully or without proper consent from your respondents.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service to distribute spam, malware, or harmful content.
• Resell, sublicence, or otherwise commercialise access to the Service without our written permission.
• Circumvent any usage limits, rate limits, or security measures.

You must create an account to use Formsout. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@formsout.app if you suspect unauthorised access.

Formsout offers Free and Pro plans. Pro plan subscriptions are billed monthly or annually through DodoPayments. All prices are listed on the pricing page and may change with reasonable notice.

• Free plan: 500 responses per month, Formsout branding shown on forms.
• Pro plan: 1,000 responses per month, remove branding, additional features.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.

Refunds are not provided except where required by applicable law or in cases of platform technical failures on our end. Annual plan subscribers who cancel within 7 days of their initial purchase may request a pro-rata refund, excluding payment gateway fees.

You may use Formsout to create unlimited forms within your plan's response limits. We reserve the right to throttle or suspend accounts that place unreasonable load on our infrastructure or use the Service in a manner inconsistent with fair use.

You retain ownership of the forms you create and the responses collected through them. By using the Service, you grant us a limited licence to store and process your content solely to provide the Service. We do not sell your data or your respondents' data to third parties.

Free plan forms display Formsout branding. Pro plan subscribers may remove Formsout branding. We may list your organisation as a Formsout user in our marketing materials unless you request otherwise in writing.

We aim to keep Formsout available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will not be liable for any loss or damage resulting from unavailability of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

To the fullest extent permitted by law, Formsout shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

We may suspend or terminate your account at our discretion if you violate these Terms, with or without notice. Upon termination, your right to access the Service ceases. We will retain your data for 30 days after termination before deletion, unless required otherwise by law.

We may update these Terms from time to time. We will notify you of material changes by email or by a notice within the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Mumbai, India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai, India.
